Terms of Service
Last updated: September 30, 2026
These Terms of Service (“Terms”) apply to your use of the Gardenia's Fire website and to tastings, orders and deliveries you arrange with Gardenia's Fire (“we”, “us”). By using our website or ordering from us, you agree to these Terms.
Our services
We prepare and deliver fresh fruit arrangements (“Office Gardens”) and individually portioned fruit cups (“Garden Cups”) to workplaces and events within our delivery area. Photos on our website are for illustration. Actual fruit varies by season and availability, and we may substitute items of similar quality and value.
Free tastings
Free tastings are offered to eligible businesses in our delivery area, subject to availability, and may be limited to one per business. We may decline or reschedule a tasting request at our discretion.
Orders, pricing and payment
- Prices shown on our website are in US dollars and may change. The price that applies is the one confirmed with you when your order is placed.
- An order is accepted once we confirm it with you. We may decline an order, for example if the address is outside our delivery area.
- Payment is due as agreed when your order is confirmed. Applicable taxes are added where required.
Delivery
- We aim to deliver at the date and time agreed with you. Delivery times are estimates, and delays caused by traffic, weather or other events beyond our control may occur.
- Please make sure someone is available to receive the delivery, or give us clear drop-off instructions. Once delivered, the order is your responsibility.
Recurring deliveries
If you set up weekly or every-other-week delivery, it continues until you skip, pause or cancel. You can do this at any time with no cancellation fee by letting us know before the order cutoff for your next delivery (by 3pm the day before). Changes made after the cutoff apply from the following delivery.
Food safety and allergies
- Our products are fresh, perishable food. Refrigerate anything not eaten within a few hours of delivery and consume within the time we recommend.
- Some items may contain or come into contact with common allergens, such as chocolate, dairy, nuts or soy, in our preparation area. We cannot guarantee any product is allergen-free.
- If you or your guests have food allergies or dietary requirements, tell us before ordering, and please pass this information on to everyone who will be eating the order.
If something isn't right
If your order arrives damaged, incomplete or not as described, contact us on the day of delivery, with a photo if you can, and we will work with you to make it right, for example with a replacement or credit. Because our products are perishable, we cannot accept returns.
Using our website
You agree not to misuse our website, including by submitting false information, sending spam, or trying to interfere with its security or operation. The website's content, including text, photos, logos and design, belongs to us or our licensors and may not be copied without permission.
Privacy
Our Privacy Policy explains how we collect and use your information.
Disclaimers and limitation of liability
Our website is provided “as is”. To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of our website or services, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.
Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Orders already confirmed are governed by the Terms in effect when they were placed.
Governing law
These Terms are governed by the laws of the state in which Gardenia's Fire is established, without regard to its conflict-of-law rules.
